R v. Zadeh, 2016 BCCA 474

Tam Boyar was co-counsel for the defendant in connection with a successful conviction appeal. The defendant was charged with one count of sexual assault and one count of administering a stupefying or overpowering substance (namely, GHB). He was convicted at trial and our firm was retained to bring an appeal on his behalf. Due to our comprehensive understanding of the expert evidence tendered at trial, we were able to establish that the trial judge’s findings were incompatible with the evidence and could not be permitted to stand. Accordingly, the Court of Appeal ordered a new trial.
